Legal Guardianship: When someone cannot take care of him or
herself and someone else wants to take care of them a legal guardianship is
needed. When a person is guardian of an estate, that guardian is legally able to
make all financial and healthcare decisions for the incapacitated person.
Compared to a power of attorney – the person holding that power is called the
attorney-in-fact (AIF) – the AIF has legal authority to do whatever the
document, durable power of attorney, authorized the AIF to do.The reason we petition for guardianship is that Social Security, doctors and nursing homes cannot talk to certain people – so we fix that in the courts with a legal guardianship.
